Terms of service

These terms govern the use of Nexo, the AI receptionist for WhatsApp and business management service provided by the owner of Nexo (“Nexo” or “we”). By creating an account or using the service you accept them. They are written to be understood at first reading; if you have any questions, write to us through the contact form.
1. Who can use Nexo
Nexo is designed for businesses and professionals who use it in their work; it is not intended for consumers. To sign up you must be of legal age, be able to contract on behalf of your business and give true details.
You are responsible for what is done with your account. Keep your password secret and tell us straight away if you think someone has got in without permission.
2. What the service includes
Nexo answers your customers on WhatsApp with the information you set up, checks your availability and books appointments in your Google Calendar, and gives you tools for payments with receipts, quote follow-ups, stock, team time off, alerts and integrations.
We may improve, change or withdraw features. If a change significantly reduces what you signed up for, we will tell you reasonably in advance and you will be able to cancel.
3. Free trial, price and payment
- The first week is free, once per customer. To start it we ask for a card, but nothing is charged during the trial.
- Unless you cancel before the trial ends, the subscription renews automatically every month at the current price: €50 a month for each business in your account. You can also subscribe straight away, without a trial.
- Payments are processed by Stripe. Before confirming you will see the exact amount that will be charged.
- If you add or delete businesses, the amount is adjusted proportionally on your next invoice.
- If a payment fails, the dashboard is locked until you update your payment method. Your data is kept.
- We may change the price of future renewals by giving you at least 30 days’ notice. If you do not agree, you can cancel before it applies.
4. Cancellation and refunds
You can cancel at any time from the billing portal (Subscription › Manage subscription). Cancelling stops the renewals and you keep access until the end of the period already paid.
As the service is provided to professionals, periods already started are not refunded, unless the applicable law requires it or the service was unavailable for reasons attributable to us.
5. WhatsApp and other services you connect
Nexo connects to WhatsApp as a linked device, just like WhatsApp Web. WhatsApp, Google, Stripe, Telegram, Slack and any other service you connect have their own terms, and you must comply with them.
In particular, WhatsApp may restrict or block numbers that send unwanted or bulk messages. Use Nexo to look after the people who write to you and your own customers; we recommend a number dedicated to the business. We are not responsible for the decisions those services take about your accounts.
6. Artificial intelligence
The assistant’s replies are generated automatically from your business information and may contain mistakes. Review the conversations regularly and keep that information up to date.
The assistant does not give medical, legal or financial advice: it passes those questions to your team. You decide what information you give the assistant and you are responsible for it.
7. Acceptable use
You may not use Nexo to:
- send spam, unsolicited bulk messages or misleading content;
- process personal data without a legal basis or without informing the people concerned;
- break the law or infringe the rights of others;
- try to access other customers’ data, disrupt the service or get round its limits;
- resell the service without our written permission.
If we detect such use, we may suspend the account, telling you beforehand whenever possible.
8. Your data and your customers’ data
The data you upload or that Nexo receives for your business (conversations, appointments, payments, stock and team) belongs to you. We process it only to provide the service, as a data processor, under the data processing agreement, which is part of these terms.
Towards your customers and your team, your business is the controller of that data: you must inform them and have a legal basis to process it. How we process your account data is explained in the privacy policy.
9. Receipts and tax obligations
The receipts that Nexo creates are proof of payment, not invoices. Meeting your tax and invoicing obligations is your responsibility; you can connect your invoicing software through the webhooks or the API.
10. Availability and support
We work to keep Nexo available at all times, but we cannot guarantee an uninterrupted service: there may be downtime for maintenance, supplier failures or causes beyond our control. If something does not work, write to us through the contact form.
11. Liability
We provide the service with professional diligence. As far as the law allows, we are not liable for indirect damage or loss of profit, and our total liability to you is limited to what you have paid for Nexo in the 12 months before the event that gives rise to it.
Nothing above limits any liability that the law does not allow to be limited, such as liability for wilful misconduct or gross negligence.
12. Closing your account and deleting data
You can stop using Nexo whenever you like. After you cancel, we keep your data so that you can reactivate the account. If you want us to delete it, ask through the contact form and we will delete it within 30 days at the latest, except what we must keep by law. You can also delete each business from the dashboard.
We may close accounts that seriously breach these terms.
13. Changes to these terms
If we change these terms, we will tell you in the dashboard or by email at least 30 days before they apply to your subscription. If you do not agree, you can cancel.
14. Governing law
These terms are governed by the law of the country where the owner is established. Any dispute will be submitted to the courts of the owner’s domicile, unless a mandatory rule provides otherwise.
If any clause is invalid, the rest will continue to apply.
